TRUTH AND DOCUMENTS IN FAMILY LAW

Parties in family law litigation need to:

  1. Fully and frankly disclose his/her financial circumstances.
  2. Be aware that there may be independent documents that support their evidence on their financial circumstances or disapprove their asserted financial circumstances.

Example: In one case, the Husband said his annual income was only about $150,000. It was indisputably proven that he declared his annual income to be $750,000 in an application to rent an apartment for $1,850 per week.

Other examples of objective or independent documents include, but are not limited to,:

  1. Tax Returns
  2. Bank statements
  3. Payslips
  4. Superannuation member’s account statements
  5. Applications for loans
  6. Credit card statements
  7. Share registers
  8. Valuations
  9. Insurance policies
  10. Contracts
